Terms & Conditions

Please read these terms carefully before submitting an enquiry or placing an order.

1. Introduction

These Terms & Conditions govern the use of the Farmiti Global website and any business transactions related to bulk spices, ginger products, and natural honey, including bulk supply and private label solutions.

By submitting an enquiry, requesting a quotation, or placing an order, you agree to these terms.

2. Company Positioning

Farmiti Global operates as a B2B exporter of spices and natural products from India, offering bulk supply and private label services.

We source raw honey from independent beekeepers and conduct controlled value-added processing, blending, and packaging before export. Packaging materials and labeling services may be coordinated through approved third-party vendors.

3. Quotations & Orders

All quotations are subject to confirmation.

Prices may vary based on raw material availability, packaging customization, and freight conditions.

Orders are confirmed only upon written confirmation and agreed payment terms.

Verbal agreements are not considered binding.

All quotations are valid for a limited period and subject to change based on raw material and market conditions.

An order is considered confirmed only upon written agreement and receipt of advance payment (if applicable).

4. Minimum Order Quantity (MOQ)

MOQ varies depending on:

  • Bulk drum shipments (container-based)
  • Bucket shipments (pallet-based)
  • Retail private label (production batch-based)

Final MOQ is communicated during quotation stage.

5. Payment Terms

Payment terms are defined in the Proforma Invoice and may include:

  • Advance payment
  • Partial advance + balance before shipment
  • Other mutually agreed structures

Production may commence only after agreed payment confirmation. In case of payment delay, shipment may be postponed without liability.

All international payments are processed via bank transfer (TT) unless otherwise agreed in writing.

All bank charges outside India are to be borne by the client.

6. Incoterms & Shipping

Our preferred shipping basis is:

  • FOB – Indian Port

CIF quotations may be arranged upon request.

Once goods are handed over to the shipping line under the agreed Incoterm, risk transfer is governed by the selected Incoterm.

Risk transfers to the buyer once goods are delivered to the shipping line under the agreed Incoterm (FOB basis unless otherwise agreed). Title to the goods passes to the buyer upon full payment unless otherwise agreed in writing

All shipments are governed by the latest Incoterms® rules as defined by the International Chamber of Commerce (ICC).

7. Samples

Pre-shipment samples may be offered based on product type and volume.

Sample costs may be:

  • Charged separately, or
  • Adjusted against confirmed bulk orders

amples may be provided free of cost (up to 250g). Courier charges are borne by the client.

8. Product Specifications

Product specifications, packaging details, and labeling formats must be confirmed in writing before production.

Buyers are responsible for:

  • Label content approval
  • Market-specific compliance verification
  • Trademark usage rights

Natural variation in color, texture, or aroma may occur due to the agricultural nature of products.

Goods are supplied in accordance with agreed specifications. No additional warranties, express or implied, are provided beyond written agreement.

9. Export Documentation

We provide export documentation as required under Indian export regulations and buyer agreement, including but not limited to:

  • Commercial Invoice
  • Packing List
  • Certificate of Origin
  • Phytosanitary Certificate
  • Shipping Bill
  • Bill of Lading

Additional certifications may be arranged upon request, subject to availability.

Documentation is provided based on agreed order terms and destination country requirements.

10. Quality & Inspection

We conduct structured processing and quality supervision prior to shipment.

If third-party inspection is required:

  • It must be requested before shipment
  • Costs are borne by the buyer unless agreed otherwise

11. Lead Time

Production lead time depends on:

  • Order volume
  • Packaging customization
  • Label approval timeline

Estimated timelines are shared after order confirmation. Delays caused by force majeure events are not considered contractual breaches.

12. Limitation of Liability

Farmiti Global Pvt Ltd shall not be liable for:

  • Delays caused by customs authorities
  • Shipping line disruptions
  • Regulatory changes in destination country
  • Improper storage after delivery

Liability is limited to the invoice value of the goods supplied.

Farmiti Global shall not be liable for delays or damages caused by third-party logistics providers or customs clearance processes.

13. Force Majeure

We shall not be held responsible for failure or delay caused by events beyond reasonable control, including but not limited to natural disasters, port congestion, regulatory changes, or global supply disruptions:

  • Natural disasters
  • Government restrictions
  • Trade sanctions
  • War or political instability
  • Shipping disruptions

14. Governing Law

All transactions shall be governed by the laws of India.

Any disputes arising shall be subject to the exclusive jurisdiction of courts located in West Bengal,Kolkata, India.
